POLYV Cloud Video Service SLA

The Polyv Cloud Video Service Agreement (hereinafter referred to as "this Agreement") is a contract entered into between Yifang Information Technology Co., Ltd. (hereinafter referred to as "the Company") and the user (hereinafter referred to as "you") regarding the Polyv Cloud Video Service and related matters. By affixing a seal, clicking to confirm on a web page, or otherwise choosing to accept this Agreement, you represent that you have reached an agreement with the Company and agree to be bound by all the terms and conditions of this Agreement. In the event of any inconsistency between the sealed text of both parties and the service terms text confirmed by web page click or other means of acceptance, the sealed text of both parties shall prevail. Before accepting this Agreement, please read all the terms of this Agreement carefully. After reading, if you continue to use the Polyv Cloud Video Service, it means you accept this Agreement and agree to be bound by it; if you do not agree to this Agreement, you may choose not to use the Polyv Cloud Video Service.

  1. Data Storage Persistence 1.1 The persistence of data storage for Polyv Cloud Video Storage is 99.9999%. 1.2 Definition of Data Storage Persistence: The probability that data remains in a stored state without loss during the contract period. A persistence of 99.9999% means that for 1,000,000 bytes of user data per month during the contract period, the probability of no data loss per month is 99.9999%, i.e., the possibility of only 1 byte of data loss per month. The statistical period is a calendar month; less than a month is counted as one month. 1.3 This type of data mainly refers to data stored by the user on the hard disk media they use, excluding data in memory.

  2. Data Deletability 2.1 When you request data deletion or before equipment is discarded or resold, Polyv will completely delete all user data through a high-level zeroing operation, making it unrecoverable, and will degauss scrapped hard drives. 2.2 The scenario of complete user data deletion does not include Polyv retaining data for 7 days for users who have not renewed their service in time, to prevent important data from being deleted because users cannot renew in time for some reason.

  3. Data Portability 3.1 The Company commits that users can control the migration of data stored in the Cloud Video Service, ensuring data can be migrated in and out when enabling or disabling this cloud service. 3.2 The Company provides corresponding tools and technical means during user migration in and out, maintaining maximum compatibility with the user's existing data format. Please refer to the help documentation for specific import and export operation steps.

  4. Data Confidentiality 4.1 Polyv adopts effective isolation methods to ensure that user data within the same resource pool is mutually invisible. 4.2 Cloud Video Service storage is isolated by account, using program isolation technology to ensure data between different users is mutually invisible and inaccessible via the intranet. 4.3 Without user authorization, Polyv commits not to view configurations, data files, etc., within the user's space. However, Polyv has the right to monitor the user's service operation data from outside the Cloud Video Service storage, including CPU usage, memory usage, etc. For ease of operation, maintenance, and troubleshooting, Polyv reserves the right to view the operation records of Cloud Video Service storage users. 4.4 Without user authorization or a government agency request, Polyv will not view user data. Related operations by operation and maintenance personnel will be recorded in detail and can be queried via logs.

  5. Data Right to Know 5.1 You can view the remaining space of Cloud Video Service storage in the product management center. 5.2 Data in Cloud Video Service storage will have two copies in the data center where the storage resides and one backup in another data center. 5.3 All data centers shall comply with the laws of the People's Republic of China. 5.4 Except for regulatory audits required by government regulatory authorities, without customer consent, user data cannot be provided to any third party, stored in foreign data centers, or used for foreign business or data analysis. To ensure the security of your use of this service and to continuously improve service quality, the Company will record and save relevant behavioral logs of your login and use of this service, used only for sales and rewards needs, and will not display user personal information data externally.

  6. Business Auditability 6.1 In accordance with national laws and regulations, and to cooperate with the regulatory audits, compliance, or forensic investigations of government regulatory authorities, the Company can provide information related to the business you run on the cloud service, such as operation logs of key components and operation records of operation and maintenance personnel.

  7. Business Functions 7.1 The service function provided by Polyv to users is the Cloud Video Service displayed on the www.polyv.net website. A complete introduction to functions and operation instructions can be found in the product user manual and help documentation. 7.2 If Polyv changes the version or functions of the service, it will notify you in a timely manner via SMS, email, website, etc., so you can make corresponding adjustments in time.

  8. Service Availability 8.1 The Company commits to you that the service availability of Polyv Cloud Video Service storage is 99.99%. If the service availability does not meet the commitment, compensation will be made according to the service compensation terms. 8.2 Definition of Service Availability: The probability of the monthly cloud service business availability time for a user during the contract period, i.e., monthly actual available time / monthly (actual available time + unavailable time). Unavailable time is defined as the period from when the user cannot use the cloud service until the cloud service returns to a normal level. The statistical period is a calendar month; less than a month is counted as one month, measured in minutes. An availability of 99.99% means that a single user's monthly cloud service business available time should be at least 30 days * 24 hours * 60 minutes * 99.99% = 43195.7 minutes, i.e., a maximum of 30 days * 24 hours * 60 minutes * 100% - 43195.7 = 4.3 minutes of unavailable time per month. The statistical unit for cloud service business unavailability is a single Cloud Video Service. An unavailability period of 1 minute or more counts as one unavailability event and is included in the unavailable time; unavailability periods less than 1 minute are not counted.

  9. Business Resource Allocation Capability 9.1 Polyv Cloud Video Service supports online upgrade and expansion (requires advance payment, manual activation). The storage unit is GB. See the order page for specific resource ranges and fees. 9.2 The quantity of Polyv Cloud Video Storage can be expanded and reduced, with a unit of GB. Expansion can be completed within 24 hours; the maximum expansion each time is 100% of the capacity, with no minimum limit.

  10. Fault Recovery Capability 10.1 Through a series of fault management systems including fault monitoring, rapid localization, automated recovery, and notification, the fault recovery capability of the cloud service is ensured.

  11. Cloud Video Service Storage Performance Metrics 11.1 The Polyv Cloud Video Storage capacity you can purchase supports 1GB to 20TB.

  12. Service Metering Accuracy Polyv has an accurate metering and billing system. Cloud Video Service storage adopts a prepayment model, with payment methods including annual subscription. Service fees are based on the then-current effective billing model and standards published on the order page.

  13. Rights Protection Category 13.1 Change and Termination Terms 1. If you need to stop using the cloud service, you must inform the Company at least 30 days in advance. The Company will refund the fees you have paid but not consumed in full. For users who do not inform the Company in advance of stopping the cloud service and do not renew in time, the Company will retain their data for 7 days. 2. The Company commits that if a certain service is no longer provided, it will notify you to transfer your business by posting an announcement on www.polyv.net or sending a website internal notification or written notice 30 days in advance. At that time, the Company will refund the fees you have paid but not consumed. 13.2 Service Compensation Terms 1. The Company commits that if the availability does not meet the service level commitment, it will compensate with a duration equivalent to the lost time. The Company is not liable for compensation for unavailability caused by your improper operation. 2. The Company is not liable for damages if the system cannot operate normally due to the following situations, preventing you from using various services. These situations include but are not limited to: (1) During scheduled system maintenance periods announced by the Company on this website; (2) Failure of telecommunications equipment preventing data transmission; (3) Force majeure events such as typhoons, earthquakes, tsunamis, floods, power outages, wars, terrorist attacks, etc., causing system obstacles preventing business execution; (4) Service interruption or delay caused by hacker attacks, technical adjustments or failures by telecommunications departments, website upgrades, bank-related issues, etc. 13.3 User Restriction Terms 1. You have the right to enjoy the internet technology and information services provided by Polyv, and have the right to receive technical support, consultation, and other services from Polyv during the period of receiving services. See the relevant Polyv product introductions for service details. 2. You guarantee not to use technical or other means to damage or disrupt the Polyv website or the websites of other Polyv customers. 3. You guarantee to respect the intellectual property rights and other legal rights of Polyv and other third parties, and guarantee to do your best to protect Polyv, its employees, partners, etc., from being affected or suffering losses due to such events in the event of infringement of such rights; once infringement occurs, Polyv reserves the right to terminate providing services to you without refunding any fees. 4. You shall bear all losses caused by incorrect contact information provided by you to Polyv, including but not limited to consequences and losses resulting from your failure to receive relevant notifications from Polyv in a timely manner. 5. You guarantee that when using Polyv services, you will comply with national and local laws and regulations, industry practices, and social public morality, and will not use the services provided by Polyv to store, publish, or disseminate the following information and content: any content (information) that violates national laws, regulations, and policies; political propaganda and/or news information that violates national regulations; information involving state secrets and/or security; feudal superstition and/or obscene, pornographic, indecent information or information inciting crime; lottery prizes, gambling games; information that violates national ethnic and religious policies; information that hinders the safe operation of the internet; information that infringes upon the legitimate rights and interests of others and/or other information or content detrimental to social order, social security, or public morality. You also commit not to provide any convenience for others to publish the above information content that does not comply with national regulations and/or the terms of this service, including but not limited to setting URLs, BANNER links, etc. You agree that Polyv has the right to terminate providing services to you without refunding any fees when you violate the above terms. If your actions cause losses to Polyv, you shall compensate. 13.4 Polyv Disclaimer Terms 1. Polyv is not responsible for any accidental losses caused by your improper operation. 2. Under no circumstances shall Polyv be liable for any form of liability for failure to provide services or delay in providing services caused by force majeure and unforeseen events. For the purposes of this clause, force majeure and unforeseen events refer to all unforeseeable, unavoidable, and insurmountable natural and social phenomena and objective circumstances, including but not limited to normal equipment maintenance of information networks, information network connection failures, failures of computers, communication or other systems, power failures, wars, natural disasters, government actions, etc.
